Commanda Law (“Commanda Law” or “we” or “us”) is committed to protecting the privacy and confidentiality of personal information. This Privacy Policy explains how we collect, use, disclose, safeguard, and retain personal information in accordance with applicable federal Canadian and Ontario laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA), and the Rules of Professional Conduct of the Law Society of Ontario. To the extent inconsistent with our lawyers’ professional obligations established by the Law Society of Ontario, this Privacy Policy is superseded by such obligations.

This Privacy Policy applies to personal information about identifiable individuals, including clients, prospective clients, website users, and others we interact with.

It does not apply to:

  • Business contact information used solely for business purposes

  • Publicly available information as defined by law

  • Information that is not considered personal information under applicable law

Consent

We obtain consent to collect, use, and disclose personal information, except where otherwise permitted or required by law. Consent may be express (ex. written or verbal agreement) or implied (ex. when a client retains Commanda Law). You may withdraw consent at any time, subject to legal or contractual restrictions (including solicitor-client privilege). Withdrawal may affect our ability to provide legal services.

If you provide Commanda Law with personal information about another individual, you confirm that you have the necessary consent or authority to do so.

What Is Personal Information

“Personal information” means information about an identifiable individual. This may include, for example:

  • Name and contact information

  • Identification information

  • Financial or billing information

  • Information relating to legal matters

Business contact information used solely for business purposes is generally not considered personal information.

Canada’s Anti-Spam Legislation (CASL)

Commanda Law complies with Canada’s Anti-Spam Legislation. We will only send commercial electronic messages where permitted by law.

 

All such messages will include:

  • Contact information; and,

  • An easy way to unsubscribe.

 

You may withdraw your consent at any time.

 

Retention and Destruction

We retain personal information only as long as necessary to:

  • Fulfill the purposes for which it was collected; and,

  • Meet legal, regulatory, and professional obligations.

Client files are retained in accordance with applicable legal and professional requirements.

Requests must be made in writing and may require identity verification. We will respond within the time required by law. A reasonable fee may apply where permitted.

 

In certain circumstances, we may be unable to provide access (for example, where information is protected by solicitor-client privilege or relates to another individual).

 

Disclosure Outside Canada

Personal information may be stored or processed outside of Canada by third-party service providers. As a result, your information may be subject to the laws of those jurisdictions, including lawful access by courts, law enforcement, or regulatory authorities.

We take reasonable steps to ensure that appropriate protections are in place.
